Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of Lobstir ("Service"), a managed AI agent hosting platform operated by Ghumaan Ventures, LLC ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

Lobstir is a managed hosting platform for OpenClaw AI agents. The Service provides:

  • Isolated Docker containers running OpenClaw instances
  • Dashboard for managing AI agent configuration, channels, and scheduling
  • Integration with messaging channels including WhatsApp, Telegram, Discord, and Slack
  • Automated container lifecycle management, networking, and TLS encryption

3. Account Creation

To use the Service, you must create an account using Google OAuth. You agree to provide accurate information and are responsible for maintaining the security of your account. You must notify us immediately of any unauthorized access.

You must be at least 18 years old to use the Service.

4. Subscription and Billing

The Service operates on a paid subscription model processed through Stripe. By subscribing, you agree to:

  • Pay the subscription fees for your chosen plan (Starter, Pro, or Business)
  • Authorize recurring charges at your selected billing interval (monthly or annual)
  • Accept that subscription fees are non-refundable except as required by law

We reserve the right to change pricing with 30 days' notice. Existing subscriptions will honor their current billing period before any price changes take effect.

5. Bring Your Own Key (BYOK)

The Service uses a Bring Your Own Key model for LLM (Large Language Model) API access. This means:

  • You provide your own API keys from LLM providers (Anthropic, OpenAI, Google, Groq, OpenRouter, or others)
  • You are solely responsible for all costs incurred through your LLM API keys
  • We do not subsidize, bundle, or resell LLM API access
  • Your API keys are stored in your agent's encrypted container configuration and are not logged, transmitted to, or accessed by Lobstir servers beyond passing them to your OpenClaw container

You are responsible for monitoring your LLM API usage and managing rate limits, quotas, and billing with your chosen provider.

6. Acceptable Use

You agree not to use the Service to:

  • Generate or distribute illegal content
  • Send spam, unsolicited messages, or engage in harassment
  • Attempt to access other users' containers, data, or accounts
  • Circumvent container resource limits or security controls
  • Use agents for fraud, impersonation, or deceptive practices
  • Violate the terms of service of connected messaging platforms
  • Distribute malware or engage in any form of cyber attack
  • Mine cryptocurrency or run unrelated workloads inside containers

We reserve the right to suspend or terminate accounts that violate these terms without notice.

7. User-Generated Content

You are solely responsible for all content generated by your AI agents. This includes messages sent through connected channels, scheduled task outputs, and any interactions with third parties. We do not monitor, review, or moderate agent output in real time.

You agree to comply with all applicable laws regarding automated messaging, including but not limited to anti-spam regulations and data protection laws in your jurisdiction.

8. Container Isolation and Security

Each agent runs in an isolated Docker container with security constraints including:

  • Memory and CPU resource limits
  • Read-only filesystem with dedicated persistent volumes
  • Dropped Linux capabilities (cap-drop ALL)
  • Isolated networking per tenant
  • TLS encryption via Caddy reverse proxy

While we implement industry-standard security measures, no system is completely immune to vulnerabilities. We are not liable for security breaches resulting from your API key exposure, weak channel configurations, or vulnerabilities in third-party software.

9. Data Handling

Your agent data (configuration, channel sessions, personality files, and scheduled tasks) is stored on persistent Docker volumes associated with your containers. When you delete an agent, the associated container, network, and volume data are permanently destroyed.

We do not access the contents of your containers except as necessary for debugging issues you report, and only with your explicit consent. See our Privacy Policy for details on data collection and handling.

10. Service Availability

The Service is currently in beta. We make no guarantees regarding uptime or service level agreements (SLAs). While we strive for high availability, the Service may experience:

  • Planned maintenance windows
  • Unplanned outages
  • Feature changes or deprecations
  • Breaking changes to APIs or configurations

We will make reasonable efforts to notify users of planned maintenance and significant changes.

11. Beta Disclaimer

The Service is provided on a beta basis. Features may be added, changed, or removed at any time. We encourage feedback but make no commitments regarding feature requests or timelines. The beta status does not affect your billing obligations for active subscriptions.

12. Termination

You may cancel your subscription and delete your account at any time through the Stripe Customer Portal or by contacting support. Upon cancellation:

  • Your agents will be stopped at the end of your billing period
  • Container data will be retained for 30 days, then permanently deleted
  • Your account information will be handled per our Privacy Policy

We may terminate or suspend your account immediately for violations of these Terms, non-payment, or at our sole discretion with reasonable notice.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOBSTIR AND GHUMAAN VENTURES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, revenue, or profits
  • Costs incurred through LLM API usage
  • Damages arising from agent-generated content
  • Service interruptions or outages
  • Third-party messaging platform policy violations

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Ghumaan Ventures, LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your agents' output, or your violation of these Terms.

15. Modifications to Terms

We may update these Terms at any time. Material changes will be communicated via email or a notice on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
